Terms & Conditions — please read carefully
1. Acceptance of Terms
By accessing or using the website and services of HOSTRIX SECURED HOSTING (“Provider”), you confirm that you have read, understood, and accept these Terms and Conditions (“Terms”). If you use the services on behalf of an organization, you confirm that you have the authority to do so.
2. Definitions
- User: the individual or legal entity that creates an account and/or uses the services.
- Customer: the User who places an order for services.
- Services: web hosting, VPS, dedicated servers, game servers, domain registration, SSL certificates, and related services.
- Account: the interface through which the User manages services.
- AUP: Acceptable Use Policy.
- SLA: Service Level Agreement (availability, compensation).
- Content: any data, files, code, or materials uploaded or stored by the User.
3. Eligibility
You must be at least 14 years old to order and use the services. If you are between 14 and 18, parental/guardian consent is required.
4. Account and Security
- You are responsible for keeping your login details confidential and for all activity in your account.
- Sharing your account with third parties is prohibited without the Provider’s written consent.
- Notify us immediately of any suspected unauthorized access at support@hostrix.ro.
5. Orders, Activation, and Migration
- The distance contract is formed when the order is placed and the Terms are accepted.
- Services are activated after payment confirmation.
- Initial migration: [free/paid], within [X websites / X GB]; special offers may have different conditions.
6. Pricing, Payments, Renewals, and Refunds
- Prices are displayed on the website and may be updated periodically; changes do not affect subscriptions already paid.
- Renewal may be automatic if the option is enabled in your account.
- Non-payment at the due date may result in suspension, followed by data deletion after [X] days.
- Refund policy: A refund may be requested within 14 calendar days from the date of the first purchase of the service. Exclusions: domains, SSL certificates, software licenses, already-consumed services, custom migration costs.
7. Domains
- Domain registration, transfer, and renewal are processed after payment confirmation, according to each registry’s (TLD) rules.
- Registrant data may be transmitted to the registry/competent authority; WHOIS protection may be available for an additional fee.
8. Service Use (AUP)
- Illegal use is prohibited, including distributing malware, phishing, SPAM, network attacks, torrents, or abusive file sharing.
- The Customer must keep applications updated and remediate reported vulnerabilities.
- Using servers for cheats, exploits, or behavior that affects other players on game servers is prohibited.
- The Provider may suspend or terminate services for serious AUP violations without prior notice.
9. SLA and Availability
- Availability target: 99.9% monthly. If downtime exceeds the threshold, the Customer may request proportional credits.
- Compensation is granted upon request, based on technical logs, and does not include indirect losses.
10. Communication and Support
- Communication is provided via email, support tickets, and the client area.
- Response times may vary depending on complexity and the purchased plan level.
11. Limitation of Liability
- The Provider is not liable for indirect, special, or consequential damages, including loss of profit or reputation.
- Total cumulative liability to the Customer is limited to the value paid for the affected service in the last [X] months.
- The Customer is responsible for their own backups, unless they have purchased managed backup services.
12. Final Provisions
- We reserve the right to modify the Terms; the updated version is published on the website and takes effect on the publication date.
- Disputes will be resolved amicably; if no resolution is reached, they will be handled by the competent courts.
13. Game Servers and Dedicated Servers
- Game server and dedicated server services are provided for lawful and ethical use of games and software applications.
- The Customer is responsible for configuring, administering, and securing the server, including software updates, plugins, themes, and any third-party files.
- Using the server for cheats, exploiting game vulnerabilities, DDoS, spam, or any activities that affect other players or external servers is prohibited.
- The Provider may suspend or shut down the server without notice in case of illegal activities or violations of the AUP.
- Server performance may vary depending on allocated resources and user traffic. The Provider does not guarantee a specific FPS or ping for game servers.
- Backups for game and dedicated servers are the Customer’s responsibility, except for managed backup services.
- The Provider may implement resource limiting policies to prevent abuse and maintain infrastructure stability.
- In case of service disruption due to maintenance or technical incidents, the SLA applies according to Section 9 and compensation is proportional to the downtime period.
